Historically, the problem of immigration affected the life of the society consistently. Immigrants were traditionally viewed as a sort of outcasts, an inferior race, which cannot have equal rights compared to the dominant ethnic group. In this regard, the position of illegal immigrants was particularly difficult because they were deprived of basic legal rights and their cultural inferiority was backed up by their legal inferiority and inequality compared to the dominant group. In fact, even such a democratic country as the US failed to avoid the supremacist attitude to illegal immigrants and the recent debate over the immigration laws and the policy in relation to illegal immigrants reveal the full extent to which illegal immigrants are vulnerable to the oppression from the part of the dominant ethnic group and ruling elite. In actuality, illegal immigrants are vulnerable to the oppression from the part of the dominant cultural and ethnic group and the ruling elite, which deprive immigrants of their basic rights, even though immigrants should have a chance to gain the legal status in the country, where they have spent many years working hard and raising up their children.
First of all, it is important to lay emphasis on the fact that the problem of the illegal immigration persisted for many years in the US. In fact, it is possible to estimate that the problem of the illegal immigration persisted as long as the immigration legislation exists. Nevertheless, the position of illegal immigrants has never been so difficult as it is now after the introduction of draconian legal norms and acts which limit consistently rights of illegal immigrants and put them under a threat of being expelled from the country any time. The threat to the position of illegal immigrants in the US is real and they can be expatriated on the ground of the recent legislative changes which ban the illegal immigration and facilitate the procedure of repatriation of illegal immigrants.
Obviously, the recent legislative changes in relation to the illegal immigrants are the manifestations of the dominant, supremacist position of the dominant ethnic group. In this regard, it is important to dwell upon reasons for such consistent restrictions of the illegal immigration and oppression of illegal immigrants. First, the legislative changes have been implemented recently since the beginning of the economic recession. Moreover, the introduction of strict immigration laws and legal acts were the response of the authorities to new challenges to the national economy, such as high unemployment rates, high education, health care and social costs spent by local and state budget on the maintenance of local communities, including illegal immigrants (Persaud, 119). Second, interests of illegal immigrants were not taken into consideration at all. In addition, their rights were neglected, if not to say violated because they were deprived of an opportunity to stay in the US and now they can be sent off the US easily. Therefore, the dominant ethnic group has introduced legal norms and standards which limit the rights of the minority consistently and deprive illegal immigrants to protect their rights and to stay in the US.
On the other hand, the oppression from the part of the dominant ethnic group can face a strong opposition from the part of the minority and illegal immigrants as is the current case of the US. In this respect, Roberto Rodriguez warns on the danger of the en masse protests against the draconian legislative changes in relation to illegal immigrants (Rodriguez, 417). The researcher (Rodriguez, 417) stresses that the draconian legal norms violating rights of illegal immigrants can provoke the negative reaction from the part of illegal immigrants and the mass protests by means of which illegal immigrants can influence the public opinion and change the attitude of the public to the problem of illegal immigration and illegal immigrants. Such protests are natural because many illegal immigrants have spent many years in the US, created their families, raised up their children and now they face a threat of being expelled from the country because of their illegal status.
In such a context, it is obvious that the recent legislative changes are ineffective and they need consistent amendments to make the approach to illegal immigrants more diverse and tolerant. What is meant here is the fact that illegal immigrants should have the right and opportunity to stay in the US, at least, if they have spent a considerable time in the US, for instance, five-seven years. Benefits of the legalization of illegal immigrants can hardly be underestimated because they will increase revenues of the state and local budgets due to the involvement of immigrants in economic activities. They will become legal tax payers. Furthermore, the US needs the labor force and immigrants represent one of the major source of the labor force in the US because the fertility rate in the US is relatively low, whereas in immigrants families the fertility rate is consistently higher than the average fertility rate in the US (Jeffrey, 21).
Thus, the US should develop more tolerant policy in relation to illegal immigrants and tackle the problem of the illegal immigration in a civilized way.
