In economic terms, exports of goods protected by copyright, is one of the most important budget items in the U.S. Indeed, copyrights are the most democratic of all types of intellectual property, as applies to virtually everyone on the planet. The topic about copyrights has a very debatable character nowadays, and we are going to make a summary of one article concerning this question.
The article presents a kind of debates on the necessity to grant copyrights to works by foreign authors, such artists from Shostakovich to Jimi Hendrix, taking into account the fact that copyrights of these foreign authors were never before protected in the United States.
The question has a long history that takes its beginning during the signing of the Berne Convention, and has its continuation in 1994. The problem is in fact that the 1994 law can be applied only to works that were never before copyrighted under old U.S. specific law. Copyrights have their specific limited time of action and after the end of such term a work automatically and permanently enters the public domain, where all people can use a work in a way they want. It is hard to find one decision for the situation with copyrights because the foreign writers didn’t have copyrights earlier, and Congress doesn’t know how to extend them right now.
As any kind of copyrights issues this one has its both negative and positive sides. On the one hand, art works should be protected by law, but, on the other hand, the development of new technologies offers different possibilities which could be limited by law in a great degree.
In conclusion, the article shows us the way foreign copyrights should be protected, but the decision in the case is expected to be find, and needs its further improvement and discussion before its application.
