Therefore, both companies have the burden of proof but, if the carrots were in a perfect state, than it is Chet’s Transport that has the burden of proof. Anyway, in the future, companies should define accurately the time of delivery of products and conditions of the delivery to avoid problems and spoiling of products.
• Harmon can face a risk of being unable to build the supply land because of the presence of gasoline tanks, which are potentially dangerous. This is why, Harmon should define the exact location of all tanks. Furthermore, it is necessary to find whether there is any gasoline in the tanks and how long they are out of use because the gasoline could drip away into the soil, if gasoline tanks are damaged naturally or in the course of the building of the supply land. On assessing the risks, Harmon should define whether he can build the supply land physically or probably the gasoline tanks will need to be taken away or probably there is a risk of explosion or pollution that prevents Harmon from building the supply land.
